LUYT: Light Up Your Talent

Service or product: assessments, reports, learning products, strengths based information, training, workshop, accreditation training, coaching programs, speaking services, consulting, project and programme management and/or other forms of education.

Participant: any individual participating in or purchasing a service or product.

Registration: participant’s registration for a service or product whereby an agreement is entered into between LUYT and participant.

Course Material: all material provided by LUYT to participant within the context of a service or product.

Written: also by fax, e-mail, internet or other digital means of communication.

a) These general terms and conditions apply to all agreements between LUYT and participant and or sponsor/commissioning parties and are an integral part thereof.

b) Participant and sponsors accepts these general terms and conditions on registration. The general terms and conditions can be found on the website of the LUYT.

c) Exclusion of (parts of) these general terms and conditions, amendments and/or supplements thereto, may only be made after obtaining the written consent of LUYT.

a) Registration for a service or product by participants and/or commissioning parties can take place as follows:

-> Via ordering a service or product through the web store on the website of LUYT

-> Via signing the LUYT proposal sent upon request to the participant and or commissioning parties

-> Via confirmation of their attendance via e-mail or phone

b) By registering, participant and/or a third party obliged to pay for Participant, undertake/undertakes to pay the fees.

c) Registration takes place for the entire consecutive service delivery period.

d) Participant is registered for a service or product after the registration has been confirmed by LUYT in writing.

a) LUYT can lay down entry requirements for participants of the service or products being offered, for instance in relation to previous education and work experience. LUYT can also stipulate a registration term and/or limit the number of participants in a service or product. 

b) If participant in any way hinders the usual course of a service or product, LUYT can exclude him or her from further participation. In that event the payment obligations with respect to participant’s participation shall remain in force.

a) When organizing a service or product, LUYT is entitled to deviate from the announcement if LUYT cannot be reasonably required to execute the service or product in full as announced.

b) Any amendments made by LUYT shall resemble the original announcement of the service or product as closely as possible.

c) Amendments to a service or product may be followed by changes in, for example, price and course material. Participant shall be notified of this in writing.

a) The participant and/ or commissioning party agrees to pay LUYT the fees in one installment.

b) If the fees payable are invoiced, participant and/ or commissioning party obliged to pay, shall pay the amount invoiced within 10 working days of the invoice date, provided it is paid before the start of the service and/ or before the product is received.

c) Should the participant and/ or commissioning party fail to pay LUYT within thirty (30) working days upon the delivery of his/her service and products, the participant and/ or commissioning party will pay an additional fee or equivalent to 1% of the total service or product price for penalty charges.

d) In the event that LUYT incurs costs to collect payment of an invoice these costs shall be fully payable by participant and/ or commissioning party referred to in article 6b.

a) In the event circumstances so require or the number of applicants for a service or product is insufficient, LUYT can cancel the service or product. LUYT shall inform participants about this as soon as possible but no later than 5 working days before the service or product is due to commence. In the event of cancellation, course fees already paid shall be refunded promptly and in full.

b) The right to participate in a service or product arises from a distance contract for the provision of certain services (article 7:46i Netherlands Civil Code). Participant may cancel his/her participation free of charge within a term of seven working days after receipt of the written confirmation of the registration, unless the commencement date of the service or product falls within this term and/ or with a view to the commencement date of the service or product, within this term participant has requested LUYT to send course material.

c) Except in the case of cancellation (free of charge) as referred to in 7a and 7b, the following administration/ cancellation fees are payable by participant and/ or commissioning party: workshop, training, accreditation training, coaching programme, project and programme management, and consultancy: 20% of the service & product fee in the event of cancellation up to 10 working days prior to commencement of the service and/or product; Thereafter up to the commencement of the service or product 100% of the service and/or product fee. The number of working days is calculated from the date upon which LUYT received the cancellation.

d) If participant or commissioning party has already paid the sum owing to LUYT, LUYT shall repay the sum owing to participant or commissioning party, with due observance of articles 7b and 7c, to a bank account indicated by participant or commissioning party.

e) In the absence of participant, a substitute may be appointed, subject to prior notification in writing sent to LUYT. Where there are entry requirements for participation in the service or product, the replacement must be approved separately by LUYT.

f) In the event of absence, participant can also opt to postpone his registration once until the immediate next service or product period. If participant does not take part in the product or service within the one year period, the cancellation fee of 100% of the course fee will apply. LUYT does not guarantee that the service or product will actually take place or will be offered unchanged.

g) For an individual coaching session, if the cancellation occurs within 24 hours of the start date and time of the coaching session, 100% of the coaching fee will be cross-charged to the participant and/or the commissioning party.

a) The copyrights and/or other intellectual property rights associated with a service or product arranged by LUYT and/or the course material is and remains the property of LUYT and/or teacher(s) of the relevant service or product.

b) Without prior written permission, participant may not use the course material except for personal use, or reproduce the course material in any way and/or sell and/or make it available to third parties.

a) LUYT exercises great care when composing the course material, it provides. However, LUYT does not guarantee the completeness and the correctness of this course material. Liability for damage arising from any decision or action based on the course material and/or information otherwise provided within the context of the service or product is excluded.

b) Liability on the part of LUYT in respect of any damage incurred by participant due to the cancellation of (parts of) a service or product is also excluded.

c) If Participant incurs damage in respect of which LUYT is liable, that liability shall at all times be limited to a maximum amount that is equal to the fee payable by participant or the commissioning party on the basis of the agreement with LUYT.

d) Participants are responsible for advising LUYT of any medical condition and/or allergies that they have prior to the commencement of the course and of any medication that they are on that may adversely impact them while on the course. In the event that LUYT considers that these conditions are likely to create an unreasonable burden on the efficient conduct of the course, LUYT has a right to cancel the registration.

e) Each Participant is responsible for his/her own personal belongings during the course event.

f) Participant and or commissioning party indemnifies LUYT for all damages third parties may suffer as a result of any act or omission by participant with regard to the course event. Participant and or commissioning party is obliged to be adequately insured against such liability.

LUYT can terminate the agreement with participant in the event that participant fails to fulfill an obligation arising from the agreement or fails to do so on time and after receiving a warning from LUYT continues in this failure to comply.

a) All agreements with LUYT are governed exclusively by the law of the Netherlands.

b) All disputes in connection with the agreement concluded between LUYT and Participant and/ or commissioning party shall fall within the jurisdiction of the competent court at Amsterdam. General Terms and Conditions of LUYT as of 01-01-2024
